FRESNO - Jorge Javier Gracia (42, of Kerman) has been convicted of all nineteen (19) felony charges related to a Fresno County shooting spree during the months of November and December 2017, the Fresno County District Attorney’s Office has announced.
As a result of today’s convictions, Mr. Gracia faces a sentence of over two hundred (200) years to life in the California Department of Corrections and Rehabilitation when he is sentenced by the Honorable Judge Sanderson on November 5, 2018, in Department 53 of the Fresno County Superior Court. However, upon reaching age sixty (60) and after serving twenty-five (25) years, Mr. Gracia will be eligible for early release under the Elderly Parole Program.
Mr. Gracia was convicted by a Fresno County jury of:
- 1.) Six (6) counts of Assault with a Semi-Automatic Firearm with the Personal Use of a Firearm [P.C. § 245(b) & P.C. § 12022.5(a)];
- 2.) Five (5) counts of Shooting at an Occupied Motor Vehicle [P.C. § 246];
- 3.) Brandishing a Firearm at Person in a Motor Vehicle [P.C. § 417.3];
- 4.) Two (2) counts of Possession of a Firearm by a Felon [P.C. § 29800(a)(1)];
- 5.) Three (3) counts of Possession of Ammunition by a Prohibited Person [P.C. § 30305(a)(1)];
- 6.) Possession of Methamphetamine with a Firearm [P.C. § 11370.1(a)]; and
- 7.) Felony Possession of Methamphetamine with a Prior [P.C. § 11377(a)].
Mr. Gracia was also found to have two (2) prior “Strike” convictions. He was previously convicted of Rape in 1997, and Assault with Intent to Commit Rape in 1999.
Prosecutor Katherine Plante would like to commend the victims in this case for their courage in coming into court to tell their stories, would like to thank the many members of the community who called in with tips for the police at the time of the shootings, and would like to thank the jury for sacrificing several weeks of their lives to do their civic duty, and for the consideration, attentiveness, and thoughtfulness they showed during the course of the trial. This case was the culmination of the efforts of the entire Fresno County community and beyond, including first and foremost the Fresno County Sheriff’s Office (and in particular the Special Investigations Task Force), the Kerman Police Department, the California Highway Patrol, the Madera County Sheriff’s Office, and the Clovis Police Department.
