MADERA - The former prosecutor in the Dustin Gran murder trial is now awaiting his own trial for prosecutorial misconduct. A criminal complaint has been filed in the Madera County Superior Court against former Madera County Deputy District Attorney Edmund Gil. The one charge of misdemeanor  forgery was filed by the California Attorney General's office out of Fresno.

This case stems from two motions filed in the superior courts by attorney John Garvin, lead counsel for the defense in the Dustin Gran murder case. Garvin alleged judicial misconduct in his May 2, 2013 motions against the Madera County District Attorney's Office, which included mishandling of evidence.

The two motions of misconduct are a result of Gil's interference with the defense's expert witnesses who were to examine cell phones allegedly used by the defendants prior to and following the 2008 murder of Krista-Rae Pike. Stanislaus County Superior Court Judge Maria Silveria ruled that Gil was guilty of prosecutorial misconduct and that the Madera County District Attorney was responsible for the many delays that have occurred in the course of prosecuting this case.

After the motions were filed with the courts, it was revealed by the deputy district attorney Linda Dun that a declaration supposedly signed by the Madera County Victim's Rights Advocate may have been forged by someone in the Madera County District Attorney's office.

A new declaration was filed by Dunn with a legitimate signature. Recognizing the legal problem facing the district attorney's office, Madera County DA Michael Keitz submitted the matter to the California Attorney General's office for investigation.

Madera County District Attorney Michael Keitz said in a press release dated May 2, 2103, “In as much as this involves an employment issue which is under investigation, I cannot comment further at this time. However, anticipating this possibility, I contacted the Attorney General’s Office last night requesting that they conduct their own independent investigation.”

Following the investigation, Gil was terminated from his position with the Madera County District Attorney's Office. For the last few months, through his attorney, he has been in front of the Madera County Civil Service Commission attempting to persuade that board to accept his resignation in lieu of termination, avoiding the stigma of being fired.

However that is just the start to Gil's problems as Supervising Deputy Attorney General Kathleen McKenna has filed charges on behalf of the state of California against Gil for the forgery of the victim rights declaration.

McKenna is hopeful of having an arraignment date set before the end of January. At this time the presiding judge of the Madera County courts is working on scheduling an out-of-county judge to hear the case.
